Terms & Conditions

Definitions:

  • Shipper: Person responsible for transporting the vehicle.
  • Broker: Company responsible for arranging vehicle transportation.
  • Carrier: Trucking company transporting the vehicle.

Fraud Warning:

Any person who, with intent to defraud or knowing that he/she is facilitating fraud against Ship Auto Inc or its insurer, submits an application or files a claim containing a false or deceptive statement is guilty of insurance fraud.

Vehicle Transport Policy:

  • The shipper must be the legal owner of the contracted vehicle or have assigned authority to enter into this agreement.
  • Ship Auto Inc or its assigned carrier is licensed to transport vehicles, not personal belongings. We are not responsible for any personal items, stolen personal items, or damages caused due to personal items inside the vehicle.

Cross-Border Transport:

  • Any vehicle containing personal items must go in-bond to Canada with items declared on Form B4.
  • Vehicles entering the US must have personal items declared on Form 3299.
  • Undeclared items will be removed before crossing the border and shipped to a requested address at a charge of $250 USD plus shipping.
  • Shippers causing customs clearance delays are subject to additional delay fees.

Shipping Agreement:

  1. Ship Auto Inc will arrange for vehicle transport on or about the requested dates but does not guarantee specific pickup or delivery dates unless “date-specific” fees are paid.
  2. This order is subject to all carrier terms and conditions outlined in the carrier’s bill of lading.
  3. Carrier responsibility begins when the shipper or agent signs the bill of lading at pickup and ends upon signing the bill of lading at delivery.
  4. Vehicles must be driven onto and off the transporter. If site access is restricted, the shipper must arrange an alternative delivery location.
  5. Final payment must be made in US Dollars (cash) before unloading the vehicle. If the shipper fails to pay, the vehicle will be taken to the nearest terminal for retrieval at additional cost.
  6. Inoperable vehicles may require shipper assistance for loading/unloading and are subject to a $200 fee if they become inoperable during transport.
  7. Ship Auto Inc does not transport personal items inside vehicles due to federal regulations. Any shipped items are the shipper’s sole responsibility.
  8. We are not responsible for vandalism, acts of God, road debris, or flying objects.
  9. Shippers must prepare their vehicle for transport by securing or removing loose parts, accessories, or fragile items.
  10. Shippers must secure their own insurance for 100% damage or repairs.

Damage & Claims:

  1. All transport fees must be paid before filing a damage claim. The shipper or agent must inspect the vehicle upon delivery and note any damages on the bill of lading.
  2. If damage occurs, a claim must be submitted within 24 hours, including pictures and two repair estimates.
  3. Legal jurisdiction for all claims is Brevard County, Micco, Florida. Ship Auto Inc is only liable for up to the deposit amount, and not for damages caused by the assigned carrier.

Cancellations & Refunds:

  1. Orders can be canceled within 72 hours for a $175 cancellation fee. Deposits, minus this fee, will be refunded.
  2. Ship Auto Inc is a licensed and bonded Property Broker (MC#01699517). Damage claims must be processed through the carrier.
  3. We are not responsible for storage fees at ports due to customs clearance delays.

Responsibilities & Exclusions:

  1. By submitting an order (online, email, or fax), the shipper agrees to these terms.
  2. Vehicles must be available for transport. If a vehicle becomes unavailable after assignment, Ship Auto Inc reserves the right to cancel with no refund.
  3. Ship Auto Inc is not responsible for the following:
  • Damage to undercarriage, suspension, brakes, battery, exhaust system, or charging system.
  • Damage caused by poor weather or lighting conditions at pickup.
  • Damage to car phones, antennas, convertible tops, tie-downs, or leaking fluids.
  • Damage due to road debris, flying objects, freezing temperatures, or improper factory tie-downs.
  1. Cross-border vehicle delays due to law enforcement or customs clearance issues are not Ship Auto Inc’s responsibility. Additional fees may apply for extended delays.
